O papel do gestor/fiscal de obra deve convergir em torno de garantir o cumprimento de todo o projeto planejado de forma segura, correta e qualificada. A legislação brasileira não possui redação pertinentes ao assunto, algo que diverge bastante com a situação que ocorre em Portugal. Neste sentido, aponta-se a necessidade em conhecer como o fiscal de obras atua em obras brasileiras e portuguesas a luz de suas legislações e normas, sendo possível enriquecer os processos que envolvem gestão e controle da construção civil. A presente dissertação possui como objetivo geral descrever, analisar, comparar e comentar a atuação dos profissionais que trabalham com fiscalização de obras, em edifícios, frente aos procedimentos e regulamentações existente em Portugal e no Brasil. Para tal finalidade, foi utilizada inicialmente a metodologia de revisão bibliográfica, para que fosse estudado o Estado da Arte sobre o assunto, bem como estudadas normas e leis pertinentes ao tema. Por fim, foram realizados dois estudos de caso. O primeiro, a partir de um inquérito com 11 perguntas, onde foram entrevistados 4 profissionais atuantes na fiscalização de obras no Brasil e em Portugal e um segundo inquérito com 18 questões que foi disponibilizado como Google Forms e obteve respostas de 19 engenheiros brasileiros atuantes em empresas de diferentes dimensões. Conclui-se que Portugal se apresenta de forma mais evoluída, pragmática e responsável. Não somente pela presença de legislação, mas também pela descrição clara das etapas e processos construtivos. Além disso, em Portugal, percebe-se uma seriedade superior a apresentada no Brasil quanto ao cumprimento daquilo que foi contratado, conferindo benefício ao proprietário ou a própria população, nos casos de obras particulares e obras públicas, seja quanto ao orçamento, cronograma e qualidade da obra.ABSTRACT: The management of works is presented as an important component in the execution of an enterprise and can be used regardless of belonging to the public or private sector. The role of the manager inspector must converge around ensuring the fulfillment of the entire planned project in a safe, correct and qualified manner. Brazilian legislation does not have relevant wording on the subject, something that differs greatly from the situation that occurs in Portugal. In this sense, it is necessary to know how the manager works in Brazilian and Portuguese enterprises in the light of their legislation and standards, making it possible to enrich the processes that involve the management and control of civil construction. The present dissertation has the general objective of describing, analyzing, comparing and commenting on the performance of professionals who work with construction supervision in buildings, in view of the procedures and regulations existing in Portugal and Brazil. For this purpose, the methodology of bibliographic review was initially used, so that the State of the Art on the subject was studied, as well as norms and laws relevant to the subject were studied. Finally, two case studies were carried out. The first, from a survey with 11 questions, where 4 professionals working in the management of works in Brazil and Portugal were interviewed and a second survey with 18 questions that was made available as Google Forms and obtained answers from 19 Brazilian engineers working in companies of different sizes. It is concluded that Portugal presents itself in a more evolved, pragmatic and responsible way. Not only by the presence of legislation, but also by the clear description of the stages and construction processes.
