Abstract(s)
A delinquência juvenil é uma questão que nos merece particular atenção, é um
problema social que remete para a prática de factos que, à luz do direito penal, são
qualificados como crime, por indivíduos criminalmente inimputáveis em função da sua
idade, nos termos da legislação vigente em Portugal, os menores de 16 anos de idade.
A compreensão de alguns dos factores fundamentais que levam o jovem a imiscuir-se
no mundo do crime e apresentação de propostas que, de alguma forma, contribuam
para a sua diminuição estiveram na base do presente trabalho.
Parece-nos claro que a incapacidade das estruturas socializadoras para assegurarem
a conformidade, das crianças e jovens, em relação às regras que seriam desejáveis
são por todos reconhecida. É pois partindo desta questão que nos propomos a
apresentar, junto da Assembleia da República, uma proposta legislativa de alteração à
Lei Tutelar Educativa.
The juvenile delinquency is an issue that deserves our particular attention, it is a social problem which takes us back to the perpetration of actions which are regarded as crime in the light of the penal code, by criminally inimputable individuals according to their age, the youth under 16, as far as the legislation in Portugal is concerned at present. The understanding of some fundamental factors which lead the youth to take part in the world of crime and the presentation of propositions that, somehow, may contribute to their decrease were at the core of this work. It seems clear to us that the inability of social services to ensure the children and youth’s conformity to rules which would be desirable to obey, is widely recognised. It is thus taking this issue into account that we intend to present to the Assembly of the Portuguese Republic a proposition to change the Educational Tutelary Law.
