Para o CERD (2000), a comunidade Roma é objeto de discriminação na sua expressão
mais acentuada, manifestando-se no plano da educação pelo forte absentismo e abandono
escolar. Neste estudo pretendeu-se conhecer o reflexo do abandono escolar da comunidade
cigana nos tribunais superiores, designadamente da Relação. Procedeu-se a uma pesquisa tendo
sido identificados três acórdãos. Em dois desses acórdãos o abandono escolar não se constitui
como o centro da decisão do tribunal e por isso foram desconsiderados. Dado o carácter
paradigmático do Acórdão do TRL, procedeu-se à sua análise. Em síntese, uma rapariga de etnia
cigana atingiu a menarca. Para os pais, de acordo com a tradição e cultura cigana, a criança
deveria abandonar a escola como forma de preservar a sua “pureza”. A primeira instância
decidiu que a frequência da escolaridade obrigatória cedia perante a cultura e tradição ciganas.
O tribunal superior revogou a decisão impondo o “apoio junto dos pais”. Prevaleceu, pois, o
superior interesse da criança.
Abstract: For the CERD (2000), the Roma community suffers discrimination at its most pronounced expression, also visible in the education plan by the strong absenteeism and school dropout. In this study we sought to know the reflection of Roma community dropout in the higher courts. In our research we identified three Decisions. In two of those cases the dropout is not constituted as the center of the court's decision and were therefore disregarded. Given the paradigmatic character of TRL decision, we conducted its analysis. In short, one Roma girl reached menarche. For parents, according to tradition and Gypsy culture, the child should leave school in order to preserve its "purity." The lower court decided that compulsory school attendance declines towards the Gypsy culture and tradition. The high court overturned the decision imposing the "support among parents." Prevailed the superior interests of the child.
